You will be the data controller in respect of all personal information posted by you to the Site. We will be the Data Processor in respect of personal information processed by Us in providing the services to you through the Site.
The protection of your privacy in the processing of your personal information is an important concern to Us, and any personal information collected during visits to the Site is processed by Us according to the legal provisions of the DPA 1998. The Site may include links to other websites whose content is not under Our control and We cannot accept any responsibility for the content within these third-party websites.
Use and storage of your personal information
We collect the following information from you in order to register you as a member of the Site ("Registration Data"):
As a representative of a business or corporate entity: your name, your job title, the name and address of your organisation, your business email address, your business correspondence address, contact telephone numbers and areas of interest (both for you and for the business or corporate entity).
As an individual: your name, address, your email address, your contact telephone numbers and your areas of interest.
You must provide us with a user name and password when you register. We cannot register you as a member without this information.
We also collect the following related information about you (“Related Information”): IP address, ISP provider, operating system type, browser type, website from which you visit Our Site, date and length of your visit to Our Site, Sponsorship Opportunities viewed by you on Our Site, activities generated by your account including Sponsorship Opportunities listed by or purchased by you, bids placed by you, information inputted by you including but not limited to information inputted on to your profile, through any networking, connecting or socialising function available through the Site, into the Contact Facility or messages or contact made with other members.
We may also collect financial information from you including credit card details or bank account numbers. We do not store credit card details nor do we share bank account numbers with any 3rd parties.
All contributions submitted to the Site and listings posted on the Site by you are voluntary and may include personal information relating to others. You may upload personal information belonging to others only when you have informed the individual that you will use their information in this way and received their express consent.
User Content submitted to the Site by You may include personal information. You may post User Content to the Site. You should be aware that other members and users will be able to access Your User Content.
Use of your personal information
We use your Registration Data in order to register you as a member of the Site, to administer your use of the Site and to provide you with services available through the Site, such as the Auctions, payment and messaging services and Contact Facility. We may use your Registration Data to verify your identity or the accuracy of the information provided by you.
We may use your Registration Data in order to contact you by email with service-related announcements.
We may also use Your Registration Data to update Our records or for audit purposes.
We may use Related Information and/or your Registration Data for the purposes of determining whether you have complied with the Terms & Conditions and to assist us in resolving disputes between you and Us or between you and other members.
We may use Related Information and/or your Registration Data to collect and/or verify payments from you.
We may also use Related Information to manage and improve the Site and services available through the Site or to track and analyse usage of the Site and for security purposes.
We store and display User Content on Your behalf but We will not use personal information contained in User Content for our own purposes.
Cancellations of a Bid or Listing
If a Sponsorship Provider (Buyer) decides to cancel a bid they must contact Us immediately by emailing Us at firstname.lastname@example.org to confirm that they wish to cancel their bid and the reasons for cancellation. As soon as reasonably possible following receipt of such notification We may, at Our sole discretion, allow the Buyer to cancel the bid. If a Sponsorship Seeker (Seller) wishes to withdraw a Sponsorship opportunity after the end of an Auction they must notify Us immediately and We will, at Our sole discretion, confirm whether or not the Sponsorship Opportunity can be withdrawn. Please review Section 10 of our Terms & Conditions for full disclosure of our cancellation policy.
If you do not want cookies downloaded onto your machine, you can disable them by adjusting the settings on your browser. However, you may not be able to use some of the features on the Site without cookies.
Sharing Your Personal Information
We may share your personal information with third parties in the following ways:
- We may sometimes use third parties to process personal information on Our behalf. For example, to host the Site and to maintain our IT systems. Where We use a third party to process your personal information on Our behalf, we will ensure that they have adequate security measures in place to safeguard your personal information;
- We will share your information such as your account name with other members of the Site who may be located in the UK or abroad;
- We will release your personal information when We are required to do so for legal or regulatory purposes or as part of legal proceedings;
- We may give information we hold about you to third parties as part of the process of selling Our business;
- In some circumstances We may transfer your personal information to countries outside of the European Economic Area, where data protection safeguards are not as high as they are in the UK. If this occurs We will ensure that measures are taken to protect your personal information.
There is the facility on the Site to upload the details of your contacts, including (but not limited to) their name, address, email address and telephone numbers (“Contacts”). Where you have uploaded Contacts on to the Site We will (if we deem it appropriate to do so) send messages and updates to your Contacts by letter, email, SMS or through any other format to notify them about Sponsorship Opportunities that you have listed, to provide them with other marketing and advertising material and related information and to provide them with general information about the Site and its facilities and Services. You will only upload Contacts on to the Site if you have express permission from your Contacts to do so and your Contacts’ permission for Us to contact them as set out above, and you confirm that any such action by you or Us is in compliance with the DPA 1998. By uploading Contacts to the Site you confirm to us that you have such express permission from your Contacts and you agree to us contacting your Contacts as described above.
If any Contact requests that they be removed from the Site or that they are not contacted by Us in future (or they make any similar or related request) you agree that we can take any action that we deem appropriate to deal with any such request including by removing the Contact from your list of Contacts on the Site (and removing any details relating to them from the Site generally) without reference to you.
Information shared by You on the Site
Please be aware that other members of the Site as well as visitors to the Site who may not be members can see your bids and your listings including your business name.
Any information that you put on to your profile on the Site and any content that you post on the Site may be seen by others. Some communications that you send through the Site (for example, invitations, messages or requests to connect) will list your name and primary email address in the message as well as the name of the organisations you are connected with or represent. Messages that you send may also provide the recipients with information about your network and interests.
Further actions by you may allow additional information to be seen by third parties. For example, if you make a request to connect with a third party through the Site, once that request has been accepted, that third party will be able to view some of your details and information (including, for example, details about your network). Equally if you accept a request to connect with a third party through the Site, that third party will be able to view some of your details and information (including, for example, details about your network).
We are not responsible for any information that you put on to the Site as part of your profile, postings or otherwise. Your contributions are typically searchable on our Site and some content may be public and searchable on the internet. You can remove posts at any time. However, others may have copied and used the information that you shared.
If you participate in groups on the Site, share content on your network or import content, you should be aware that any information you choose to disclose can be read, collected and used by third parties, including advertisers. We are not responsible for the information that you choose to submit. Your group contributions are typically searchable on our Site and some content in groups may be public and searchable on the internet. You can remove group posts at any time. However, others may have copied and used the information that you shared.
If you provide any testimonials about the services that we provide we may post those testimonials, and any other material that you have posted, to third parties or place them on the Site or in any other material. This may include your name and other personal information that you have provided.
Using information from other members
You may need to share information with other members to complete transactions. Please be aware that when you are involved in a transaction another member may have access to your name, your user name, your business or home address, your email address, the organisations that you are connected with or represent and other contact and profile details. You agree that you will use the personal information of other users only for:
- purposes relating to the transaction or Auction;
- using services offered through the Site such as the Contact Facility; or
- any other purposes for which you have obtained prior, express consent from the member.
Access to Your personal information
You have the right to request a copy of the personal information We hold about you and to have any inaccuracies corrected. We will ask for confirmation of identity before We disclose any personal information and may charge a £10 administration fee to process the request. Unless you own or control the relevant rights in the material, you must not:
republish material from our Site (including republication on another website);
sell, rent or sub-license material from our Site;
show any material from our Site in public;
exploit material from our Site for a commercial purpose; or
redistribute material from our Site.
We reserve the right to restrict access to areas of our Site, or indeed our whole Site, at our discretion; you must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on our Site.
You must not:
use our Site in any way or take any action that causes, or may cause, damage to the Site or impairment of the performance, availability or accessibility of the Site;
use our Site to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software;
conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our Site without our express written consent;
use data collected from our Site for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing).
You must ensure that all the information you supply to us through our Site, or in relation to our Site, is true, accurate, current, complete and non-misleading.
We do not warrant or represent:
the completeness or accuracy of the information published on our Site;
that the material on the Site is up to date; or
that the Site or any service on the Site will remain available.
We reserve the right to discontinue or alter any or all of our Services, and to stop publishing our Site, at any time in our sole discretion without notice or explanation; you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any services, or if we stop publishing the Site.
To the maximum extent permitted by applicable law we exclude all representations and warranties relating to the subject matter of our Site and the use of our Site.
